The protection of your privacy rights in the processing of personal data is an important concern to MAN Truck & Bus SE. We process personal data which are collected when our website is visited in accordance with the statutory provisions of the country in which the body responsible for processing the data has its legal domicile.

In addition, MAN Group companies have committed themselves to comprehensive and uniform protection of personal data through a binding Group policy. This ensures a worldwide level of protection within the MAN Group that is comparable to that in Germany and the European Union.

Furthermore, our employees are bound by us to maintain secrecy and to protect personal data entrusted to us.

The responsible body in terms of data protection law for your data is the MAN Group company that operates the website you are visiting.

2. Information about this website

With this data privacy notice, we notify you how we collect, process and use which kind of personal data when you visit this website.

In this context, “personal data” shall mean any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

The purpose of this and other websites is to provide you with information on selected companies of the MAN Group.

The following information shall not apply to companies that MAN neither owns nor controls and shall also not apply to persons that MAN does not employ or instruct.

3. Collection of general information and anonymous usage data

When you visit our website, information of a general nature is automatically collected. This information includes the type of web browser used, the operating system used, the domain name of your internet service provider, the website you are visiting with us, as well as technical information about the visit (https/http method, https/http version, https/http status code, length of data transmitted) and the like. This is exclusively information that does not allow any conclusions to be drawn about your person. Moreover, this data is also generated when accessing any other website on the Internet. Therefore, this is not a specific function of this website.

Information of this kind is only collected anonymously and statistically evaluated by us. The better we understand your needs, the faster you will find the information you are looking for on our websites.

4. Collection and processing of personal data

a) Easy navigation on the website

When you visit our website, our web servers store your IP address from which the access is made as well as date and time of the visit by default.

b) Use of web applications

When using our web applications, information that is necessary for the effective use of this application may also be stored.

c) Registration via online forms

Further personal data is only collected if you voluntarily provide it to us and only insofar as this is necessary for the respective purpose (e.g. in the context of a registration, a subscription, a survey or a promotional competition).

d) Use of cookies

A cookie is a small data file that is stored on your device and contains data such as your personal page settings and login information. This data file is generated by the web server that you used to establish a connection via your web browser and is sent to you. In general, we use cookies to analyse interest in our web pages and to make them more user-friendly. In principle, you can access our web pages without cookies. MAN uses cookies to make its offers more user-friendly, more effective and more secure. Our cookies do not contain any person-specific information.

Session Cookies

While you are using a website, a session cookie is temporarily stored in your computer’s memory; this is effected via a session ID being stored so that you do not have to log in again every time you change page for example. Session cookies are deleted when you log off or expire as soon as your session ends automatically.

Permanent or persistent cookies

A permanent or persistent cookie stores a file on your computer for a fixed period of time until its expiration date. Using these cookies, websites remember your information and settings on your next visit. This makes access to the websites faster and more user-friendly, for example because you do not have to configure your language setting for our portal again. When the expiration date is reached, the cookie is deleted automatically when you visit the website that generated it.

First-party cookies

These are placed by the website itself (same domain as in the browser address bar) and can only be read by that particular website. These cookies are usually used to store information (for example, your settings) that will be used on your next visit to the website.

Third-party cookies

Third-party cookies originate from parties other than the website operator. They can be used to collect information for advertising, user-defined content and web statistics, for example.

e) Use of the GeoLite2 and GeoIP2 databases for geolocation

This website uses the GeoLite2 or GeoIP2 database, which is provided by the supplier MaxMind Inc. and is hosted by MAN or third-party providers. In the GeoLite2 or GeoIP2 database, approximate position or geolocation data is assigned to the IP addresses used based on their country of origin. In order to improve search results, provide you with more relevant information and to preset certain personalised website configurations which will make your visit to our website more pleasant (e.g. language settings), your IP address will be used to ascertain your country of origin via the GeoLite2 or GeoIP2 database. No personal data will be passed to third parties as part of this process.

f) Piwik PRO

We use the Piwik PRO Analytics Suite as our website/app analytics software and also manage consents with it. We are using cookies to collect data about website visitors. The information collected includes, for example, the visitor’s IP address, operating system, browser ID, browsing activity and other information. We calculate metrics such as bounce rate, page views, sessions and the like to understand how our website/app is used. We can also create visitor profiles based on the browsing history and thus analyse visitor behaviour, display personalised content and carry out online campaigns.

We host our solution on Microsoft Azure in Germany and store the data for 25 months.

Purpose of the data processing: Analytics and conversion tracking based on your consent. Legal basis: Art. 6 (1)(a) GDPR.

Piwik PRO does not share data about you with other sub-processors or third parties and does not use it for its own purposes. See the Privacy Policy of Piwik PRO for more information .

g) Consent tool OneTrust

We use OneTrust as our consent tool. With this data privacy management software, we offer you the opportunity to consent to the storage of cookies in a lawful manner and to ensure the ability to withdraw consent.

h) Integration of Google Maps (including Google Fonts)

This website integrates the Google Maps map service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4 Ireland, (hereinafter “Google”). The integration of Google Maps establishes a direct connection to the Google servers and your browser. This enables the provision of the Google Maps map. By integrating and using the Google Maps map, your browser transmits the IP address to Google for independent data processing. In addition, Google is independently responsible for processing the search terms you enter on the Google Maps map and – if you have given your consent – your current location. Furthermore, the Google Maps map also integrate what are known as Google Fonts. These are fonts provided by Google. To display the Google fonts on the Google Maps map, a connection from your browser to the Google server is established as well and your browser transmits your IP address to Google for independent data processing. The legal basis for the transfer of personal data to Google is your consent in accordance with Art. 6 (1)(a) GDPR. Your consent is valid for a period of 12 months and includes all applications on this website that integrate Google Maps (including integrated Google Fonts).

i) Video embedding

Vimeo

For embedding and streaming of videos on our website we either use the provider Vimeo or its subsidiary Livestream. Vimeo is operated by Vimeo, LLC with headquarters at 555 West 18th Street, New York, New York 10011.

If you call up a page on our website on which a video is embedded via a Vimeo plugin, your browser establishes a connection to the Vimeo servers. This transmits information on which pages you have visited to Vimeo. If you are logged in to Vimeo when you visit our website, Vimeo will also assign this information directly to your personal user account. Interactions with the plugin, for example clicking the start button, are also assigned to your Vimeo account. To prevent this allocation, you must log out of your Vimeo account before using our website.

The loading of Vimeo can be prevented via the browser settings. For detailed information on the procedure, please refer to the instructions of your browser manufacturer.

j) Adobe Analytics

Our website uses Adobe Analytics, a web analytics service provided by Adobe Systems Software Ireland Limited, 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland. Adobe Analytics allows us to analyse user behaviour and the flow of visitors. This enables us to create content in line with visitor needs and, moreover, to identify and resolve problems more quickly. For this purpose, Adobe Analytics saves cookies in your browser. By configuring the appropriate settings in Adobe Analytics, we also ensure that the last eight digits of the IP address transmitted to Adobe are removed (replaced by 0) before geolocalisation to prevent clear identification of the IP address and so that it can only be traced back to large geographic areas (regions). Moreover, the IP address is completely removed from the data record after geolocalisation so that no further conclusions can be drawn about the IP address. Adobe processes the collected data and information solely on our behalf. The purpose is to analyse user behaviour and create anonymised reports and statistics. We use the information gained in this way to optimize our website and improve our range of services. The legal basis of data processing is Section 15 (3) of the German Telemedia Act (TMG) and Art. 6 (1) (f) GDPR. The legitimate interests are the aforementioned purposes. 5. Earmarking of personal data use

Your personal data will only be used for the purpose for which you have entrusted these data to us.

6. Legal basis of data processing

The legal basis for the use and storage of your personal data is your consent in accordance with Art. 7 of the EU Data Protection Regulation (EU-DSGVO) as well as in accordance with § 13 Para. 2 of the German Telemedia Act (TMG). We process your inventory and usage data on the basis of and in accordance with the requirements of §§ 14 and 15 TMG, which constitute a legal obligation within the meaning of Art. 6 (1) lit. c EU-DSGVO, to which we are subject as website operators.

7. Disclosure of personal data

By using the features presented, entities located in third countries outside the European Economic Area (EEA) may also be able to view your data. In these countries, there may be an insufficient level of data protection due to the lack of an adequacy decision by the EU Commission and the absence of further appropriate safeguards to protect your personal data.

The transfer of your data to these third countries takes place on the basis of your consent in accordance with Art. 7 EU-DSGVO and § 13 para. 2 TMG, or on the basis of the exceptional circumstances of Art. 49 para. 1 EU-DSGVO, which come into effect through the activation of the corresponding function.

Your data can also be viewed by affiliated companies of MAN and VW Group as well as external service providers who provide and technically operate this website and the related systems. Data protection agreements have been concluded with these companies to ensure a high level of data protection.

Such data will only be passed on to government/state institutions and authorities within the framework of mandatory national legal provisions.

8. Data storage and deletion

The data related to your visit to our website (see points 1 and 2 a) is stored for two years, calculated from the time you open the website.

Other personal data is stored until you unsubscribe or inform us that you no longer wish to use the respective function.

Beyond this, data is only stored if there are legal or contractual obligations to retain data.

9. Your rights

In addition to the right of information about the data concerning you and correction of your data, you also have the right to deletion and blocking of your data as well as the right to object to the processing of your data - insofar as this does not conflict with any legal regulations. Furthermore, you have the right of data portability.

As we collect and process your personal data on the basis of your consent, you also have the right to revoke the consent you have given. Your revocation does not affect the lawfulness of the data processing carried out on the basis of the prior consent until revocation.

Where necessary, we will need to verify your identity before we can process your applications.

If, in spite of our best endeavours to ensure the correctness and actuality of the data, incorrect information is stored, we will correct this information after receiving appropriate instruction to do so.

In the event of complaints, there is the possibility of contacting a data protection supervisory authority.

10. Security

MAN uses technical and organisational security measures to protect your data so as to prevent accidental or deliberate tampering, loss, destruction or access by unauthorised persons. Our security measures, such as data encryption for example, are regularly improved in line with technological developments.

11. Links to websites of other providers

Our website may contain links to websites of other providers. MAN satisfied itself at the time of establishing the link that the directly linked pages were free of illegal content. MAN however has no influence whatsoever on the content of the linked pages and is unable to monitor these pages on a regular basis. MAN therefore cannot be held liable for the content of the linked pages which have been changed since the creation of the link. This declaration concerning data privacy protection does not apply to the linked websites of other providers.

12. Reservation

In order to keep apace with the continuous development of the internet, MAN shall be able at any time to adapt this declaration concerning data privacy protection while adhering to the provisions of data privacy protection legislation.
